1. About these terms
These Terms & Conditions govern your use of the RailFolio app, website and related services.
RailFolio is operated by Paul Wyn Martin, trading as RailFolio.
By creating an account or using RailFolio, you agree to these Terms & Conditions. If you do not agree to them, you should not use RailFolio.

2. Who can use RailFolio
RailFolio is intended for people aged 18 and over.
You must confirm that you are at least 18 when creating an account.
RailFolio does not knowingly accept accounts belonging to people under 18. If RailFolio becomes aware that an account may belong to someone under 18, access may be restricted while the matter is reviewed. An account and its associated content may be removed where appropriate.
3. Your account
You are responsible for providing accurate information when creating and using your account and for keeping your login details secure.
You must not allow another person to use your account in a way that breaches these terms.
If you believe somebody has gained unauthorised access to your account, contact support@railfolio.com.
RailFolio may restrict or suspend an account where reasonably necessary to investigate suspected misuse, protect members, maintain the security of the service or comply with legal requirements.
4. RailFolio sightings
RailFolio allows members to record and share railway sightings.
A sighting may include information such as photographs, train details, notes, location information, coordinates, and the date and time of the sighting.
You are responsible for checking the information you choose to publish.
RailFolio is a community platform and does not guarantee that information submitted by members is complete, current or accurate.
5. Photographs and other content you upload
You remain responsible for photographs, comments, notes and other content that you submit to RailFolio.
You should only upload content that you have the right to use and share.
You must not upload content that infringes another person's copyright, privacy or other legal rights.
You must not upload unlawful, threatening, abusive, discriminatory, deliberately misleading or otherwise harmful material.
By publishing content through RailFolio, you give RailFolio permission to store, process, display and make that content available as necessary to operate the service.
This permission does not transfer ownership of your content to RailFolio.
The permission ends when the content is deleted from RailFolio, except where continued processing or retention is reasonably necessary for matters such as legal obligations, disputes, security or moderation, or where independent copies have been made by other people.
6. Public content and locations
RailFolio is designed around sharing railway sightings with a community.
Sighting photographs, display names, comments and location information associated with a sighting may therefore be visible to other people.
Take particular care when adding a location.
An exact map pin may reveal a home, workplace or other private location even when the displayed location name only identifies a town or wider area.
You are responsible for checking the location you have selected before publishing a sighting.
Other people may save or otherwise retain copies of material that you make public. Deleting material from RailFolio cannot remove copies independently retained outside RailFolio.
7. Comments, likes and community behaviour
RailFolio provides community features including comments and likes.
Treat other members respectfully.
You must not use RailFolio to harass, threaten, intimidate, impersonate or deliberately deceive another person.
You must not post spam or use RailFolio to distribute malicious software, fraudulent material or unlawful content.
You must not attempt to interfere with RailFolio's operation, security, accounts, databases or other technical systems.
8. Reporting and blocking
RailFolio provides tools that allow members to report content or accounts and to block other members.
Reports may be reviewed and appropriate action may be taken where necessary.
Submitting a report does not guarantee that content or an account will be removed.
Reports must be made in good faith. You must not deliberately misuse the reporting system to target or harass another member.
Blocking another member does not necessarily make content that has already been made public private.
9. Moderation
RailFolio may review, restrict or remove content where reasonably necessary to enforce these terms, protect members, investigate reports, maintain the service or comply with applicable law.
Where appropriate, RailFolio may restrict, suspend or terminate access to an account.
Moderation decisions may take account of the nature and seriousness of the issue, repeated behaviour, risks to other members and applicable legal obligations.

10. Maps and location services
RailFolio uses mapping services to provide map and location features.
Maps, location names, coordinates and other geographical information may contain errors or may not always be available.
Do not rely on RailFolio as a navigation, railway-operational, emergency or safety service.
You remain responsible for your own safety and for complying with signs, restrictions and instructions when photographing or observing trains.
11. Railway safety and access
Using RailFolio does not give you permission to enter railway property, private land or any restricted area.
Do not trespass or place yourself or another person in danger in order to record a sighting or photograph.
Always obey applicable laws, railway safety instructions, signs and access restrictions.
RailFolio does not encourage or require members to approach railway tracks, operational railway infrastructure or other hazardous areas.
12. Intellectual property
The RailFolio name, branding, design, software and other material created for RailFolio are protected by applicable intellectual-property laws.
These terms do not give you ownership of RailFolio's software, branding or other intellectual property.
Your own photographs and other original content remain yours, subject to the permission you give RailFolio under these terms to operate the service.
13. Availability of RailFolio
RailFolio may occasionally be unavailable because of maintenance, technical problems, provider outages, updates or circumstances outside RailFolio's reasonable control.
RailFolio does not guarantee that every feature will always be available or that the service will operate without interruption or errors.
Features may be changed, added or removed as RailFolio develops.
Where a material change affects these terms or the way personal information is handled, the relevant terms or Privacy Policy will be updated as appropriate.
14. Deleting content and accounts
Members can delete individual content where the relevant feature is available and can request or use the available process to delete their RailFolio account.
Account deletion is intended to remove the account and associated RailFolio content in accordance with RailFolio's deletion processes.
Some information may need to be retained where there is a legal requirement, unresolved complaint, dispute, security matter or other legitimate reason described in the RailFolio Privacy Policy.
Copies independently retained by other people cannot be deleted by RailFolio.

15. Privacy
RailFolio processes personal information in accordance with the RailFolio Privacy Policy.
The Privacy Policy explains what information RailFolio processes, why it is used, who may receive it, how long it is retained and your data-protection rights.
16. Third-party services
Some RailFolio features depend on third-party services, including hosting, authentication, email and mapping providers.
Those services may operate under their own terms and privacy policies.
RailFolio is not responsible for independent services operated by third parties, although RailFolio remains responsible for its own obligations when using providers to process information on its behalf.
17. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability that cannot lawfully be excluded or limited under applicable consumer law.
RailFolio is provided as a community railway-sighting service. Information submitted by members may be inaccurate or incomplete, and maps or other third-party information may contain errors.
You should not rely on RailFolio for safety-critical, operational, navigation or emergency information.
To the extent permitted by law, RailFolio is not responsible for losses caused by circumstances outside its reasonable control or by your use of RailFolio in breach of these terms.
18. Ending your use of RailFolio
You may stop using RailFolio at any time and may delete your account using the available account-deletion process.
RailFolio may suspend or terminate an account where reasonably necessary because of serious or repeated breaches of these terms, risks to other members, security concerns or legal requirements.
Where appropriate and reasonably possible, RailFolio may provide information about the reason for action taken.
19. Changes to these terms
RailFolio may update these Terms & Conditions as the service develops or where changes are needed for legal, regulatory, security or operational reasons.
The date at the top of these terms will be updated when the terms change.
Where a change materially affects members' rights or use of the service, reasonable steps will be taken to bring the change to members' attention.
20. Governing law
These Terms & Conditions are governed by the laws applicable in England and Wales.
Nothing in these terms removes any mandatory rights you have under applicable consumer law or prevents you from using any court or dispute process that the law entitles you to use.
